Apply Job - Terms of Use

1. Parties and Scope

These Terms of Use govern the relationship between Besim Teknoloji Bilişim Sanayi ve Ticaret Limited Şirketi (MERSİS: 0166038224000001, address: Dodurga Mah. 103. Cadde Özdebirlik Sitesi 4/B Çayyolu 2, Türkkonut, Çankaya / Ankara; hereinafter "Besim Teknoloji" or "we") and the person who uses the Apply Job service ("User" or "you").

The "Service" covers the apply.besimtech.com web application, the Apply Job desktop application and all features offered through them. By creating an account, you accept these terms. How your personal data is processed is explained in a separate document, the Privacy Policy and KVKK (Turkish Personal Data Protection Law No. 6698) Disclosure Statement.

2. Description of the Service

Apply Job helps you to:

• Find job postings according to the search preferences you set, score them against your profile and explain them with a brief rationale,
• Fill in and submit application forms with your profile and CV details for postings that you approve or that pass the automatic approval threshold you set,
• When an application form cannot be submitted, send the employer an application e-mail containing your CV from your own e-mail account, if you have enabled this feature or at your request,
• If you choose to connect it, match e-mails from employers to your applications to make it easier to track the process,
• Offer suggestions to strengthen your CV.

Job searches and applications are carried out through the desktop application running on your computer, in your browser and with your session. Your password on the job platforms is not transmitted to us.

Besim Teknoloji is not affiliated with any job platform or employer and does not act on their behalf. The brand and product names mentioned belong to their respective owners.

3. Account and Eligibility

• You must be at least 18 years old to use the Service.
• You may use your account only on your own behalf and for your own career processes; you may not apply on behalf of another person.
• You must provide accurate information during registration and keep your account details and your computer secure. If you notice any unauthorized use, please notify us immediately.

4. Applications and User Responsibilities

4.1 Accuracy of information

Applications are sent on your behalf. It is your responsibility to ensure that the information in your profile, CV, saved answers and settings is accurate, up to date and belongs to you. The application is designed not to answer questions that have no counterpart in your saved information by making them up; for such questions it leaves the field blank or stops the application. Nevertheless, artificial intelligence and automation can make mistakes. You can monitor the submitted applications and their status in the application; if you notice an error, you can send a correction to the relevant employer.

4.2 Approval and automatic application settings

You decide which postings to apply to: you can approve postings one by one or define an automatic approval threshold. When you enable automatic approval and automatic run settings, you accept that applications matching these rules are sent on your instruction. You can change or turn off the settings at any time.

4.3 Applying by e-mail

Application e-mails are sent through your own e-mail server and on your behalf. The recipient address is determined from the job contact addresses that the employer publishes on its own website or in publicly available sources. You are responsible for the content sent and for complying with the terms of use of your e-mail account; you can keep this feature turned off in the settings and can view the sent e-mails in the application.

4.4 Relationship with employers

The evaluation of your applications, hiring decisions and any relationship between you and employers are between you and the relevant employer. Besim Teknoloji is not a placement or employment agency and does not guarantee any hiring outcome.

5. Third-Party Platforms

The Service operates on job posting platforms and employers' application systems with your account and on your instruction. These platforms have their own terms of use; some may limit or prohibit actions performed with automated tools, request security verification or restrict accounts. It is your responsibility to review the terms of the platforms you use and to act in accordance with them.

To protect your account, the application applies daily search and application limits and works at human speed. When it detects that a platform requests a verification code, captcha or similar security check, or that your session has ended, it stops the automated actions and waits until you log in again. These measures are designed carefully; however, because platforms frequently change their screens, it cannot be guaranteed that every check will be detected in every case. We have no control over the restrictions that platforms apply to your account at their own discretion.

6. Artificial Intelligence

• Posting scores, rationales, form answers and CV suggestions are generated with artificial intelligence. These outputs may contain errors; they are suggestions that help you make decisions.
• In the managed artificial intelligence option, we run the artificial intelligence and use only large models of sufficient quality. Reasonable usage limits may be applied for the sustainability of the Service.
• When you use your own artificial intelligence keys, your data is sent to the provider you choose with your account; that provider's terms of use, privacy rules and fees apply. Some providers' free usage options may use the content sent to improve their own products. Your keys are stored encrypted.
• In the local artificial intelligence option, artificial intelligence operations are performed on your own computer.

7. Plans, Payment and Right of Withdrawal

• Free trial: Accounts that have not previously used a plan and whose e-mail address has been verified can make a one-time trial without providing payment information: 10 applications with your own artificial intelligence; up to 10 posting evaluations and up to 3 one-click applications made within the job platform with managed artificial intelligence. No fee is charged during the trial, and the trial does not automatically convert into a paid plan.
• Plan and package prices are shown in the application and on the purchase screen. On the payment page, the total amount including taxes is shown before you confirm the payment.
• Payments are collected through Besim Teknoloji's secure payment page (besimtech.com/checkout); your card details are not stored in our systems.
• The application quota is reduced by one for each application sent (including applications made by e-mail). Job searching, scoring, CV reading and form filling do not reduce the application quota. The duration of the plan and the application quota it includes are shown at the time of purchase.
• Automatic renewal: Monthly and annual plans are purchased as a subscription and, until you cancel, automatically renew for the same period at the end of each period from the card you used at the time of purchase. Your card details are stored by the payment institution; we keep only the card reference provided by the payment institution. Plans offered at a discount for the first period renew at the plan's regular price in subsequent periods. Renewal is made at the price shown at the time of purchase; a price change is applied only with prior notice and starting from the next period, in which case you can cancel your subscription before renewal. One-time packages do not renew.
• Cancellation: You can cancel your subscription at any time from the user menu in the application (Subscription) or by writing to info@besimtech.com. Cancellation takes effect at the end of your current period; you continue to use the Service until that date, and no fee is charged thereafter. The fee for a period that has already started is not refunded, except where required by law.
• First-period discount: The discounted first period of monthly plans is offered once per account. It is not applied again on another account to which the same job platform account is linked, or on an account that has previously used a discounted period.
• Referral program: When a person who registers through your account-specific referral link purchases their first paid plan, 25 application credits are added to your account and 20 to the person you invited. The reward is given once per invited person and only on the first purchase; it is not given where the inviter and the invited person are behind the same job platform account, or in cases of self-invitation or opening multiple accounts. Rewards are added as application credits; they cannot be converted to cash, cannot be transferred and are subject to the terms of the purchased plan. If abuse is detected, the credits added may be reclaimed. We may change the terms of the program with prior notice or end the program; credits earned up to that date are preserved.
• The Distance Sales Contract (Turkish) and Sales and Refund Terms (Turkish) apply to sales, the right of withdrawal and refund conditions. The Service is made available electronically for use immediately after purchase; for services whose performance begins with your consent, the exceptions listed in Article 15 of the Distance Contracts Regulation apply.

8. Acceptable Use

When using the Service, you agree not to:

• Apply with false, misleading or another person's information,
• Upload or process personal data belonging to other people without being entitled to,
• Use the Service for bulk messaging, unsolicited applications or harassment,
• Attempt to circumvent the Service's security measures, usage limits or license controls,
• Use the same job platform account with more than one account; open multiple accounts or invite yourself to obtain a discount or referral reward,
• Copy, reverse engineer or distribute the application without authorization (cases mandatorily permitted by law are reserved),
• Use it for any purpose contrary to applicable legislation.

9. Service Changes and Interruptions

We may add, change or remove features to improve the Service. We will not substantially change the essential characteristics of your paid plan to your detriment without a justified reason; if such a change becomes necessary, we will inform you in advance and your right to end your plan is reserved. The Service may be interrupted from time to time due to maintenance, problems at third-party service providers or changes on job platforms. We announce significant changes within the application or on the "What's New" page.

10. Intellectual Property

The Apply Job software, its interface, brand and content belong to Besim Teknoloji. Provided that you comply with these terms, you are granted a non-transferable and non-exclusive right to use the Service for your personal use. Open-source components included in the application are subject to their own licenses. The content of your profile, CV and applications belongs to you; we use this content only to provide the Service to you.

11. Limitation of Liability

We provide the Service with care; however, we do not guarantee that it will be uninterrupted or error-free, or a particular hiring outcome, or the functioning of third-party platforms.

To the extent permitted by applicable legislation, we are not liable for loss of profit, loss of business opportunity, restrictions applied to your account by third-party platforms, or indirect damages arising from the inaccuracy of the information you provide. To this extent, our total liability is limited to the amount you paid for the Service in the last 12 months prior to the event giving rise to the damage.

These limitations do not exclude or restrict liability arising from intent or gross negligence, our legal obligations regarding the protection of personal data, or your statutory rights arising from consumer legislation.

12. Indemnification

You agree to compensate, to the extent permitted by law, for damages arising from justified claims brought against us by third parties as a result of your culpable breach of these terms or applicable legislation.

13. Force Majeure

The parties cannot be held liable for failure to fulfil obligations due to events beyond their reasonable control, such as natural disasters, epidemics, war, cyberattacks, infrastructure or power outages, interruptions of third-party service providers, and decisions of official authorities. To the extent this situation continues, obligations are suspended; if your paid service cannot be provided for an extended period, your rights regarding the unusable portion are reserved in accordance with legislation.

14. Deletion, Suspension and Termination of the Account

• You can delete your account and all data belonging to your account yourself at any time from the user menu in the application. Data that is deleted and must be retained by law is explained in the Privacy Policy. When the account is deleted, your unused application credits expire and any active subscription is cancelled at the end of the current period; no fee is charged thereafter.
• In the event of a serious or repeated breach of these terms, a security risk or a legal obligation, we may suspend or terminate your account; we will inform you in advance where possible. If we terminate your account for a reason not attributable to you, we will refund the fee for the unused paid period in accordance with legislation.

15. Personal Data

Your personal data is processed as explained in the Privacy Policy and KVKK (Turkish Personal Data Protection Law No. 6698) Disclosure Statement.

16. Changes

We may update these terms from time to time. For significant changes, we will inform you within the application or by e-mail and request your consent again. If you do not accept the changes, you can stop using the Service and delete your account. The current version is always published on this page.

17. Governing Law and Disputes

These terms are subject to the laws of the Republic of Turkey. For applications you make as a consumer, the Consumer Arbitration Committees and Consumer Courts at your place of residence have jurisdiction, within the monetary limits announced by the Ministry of Trade. For consumers residing outside Turkey, the mandatory consumer protection provisions provided to you by your country of residence are reserved. For disputes arising with non-consumer users, the Ankara Courts and Enforcement Offices have jurisdiction.

18. Miscellaneous Provisions

If any provision of these terms is deemed invalid, this does not affect the validity of the other provisions. Our failure to exercise a right does not mean that we have waived that right.

This document was prepared in Turkish; versions in other languages are for information purposes. If there is any difference between the texts, the Turkish text prevails to the extent permitted by applicable legislation.
